I wasnt going to do this becuase I think it is pretty low, but when someone or a business just goes out of their way to lie and cheat to you, then ignore government bodies in resolving complaints I think the world should no.

Everything in this blog is true and not one word is exagerated or made up and I am doing it so that no one else has to go through what I am going through.

The Story

My PS3 died and I love it and had a big event the following monday night to attend. So I did an internet search and came up with a company very local to me.

The following is the statement of facts but as a brief, I dropped off a 60Gb PS3 and ot back something from Asia that does not work in Australia. They charged me $352 which I paid before they delivered this thing to me.

When I complained they said they repaired mine. Then after 2 weeks they said the swapped mine.

I went to dropp this one off and pick up mine but I was threatened with violence. All I wanted was my PS3 back, not this asian model that doest work here in Australia.

I have been in contact with the Police who have a complaint but I have also been to consumer protection. I got a call from them the other day saying they could not belive their response to me or them. Paul has offered to restore my PS3 for an extra $380 and I can pick up my old PS3 in a shoe box.

I had this blog ready to go a couple of weeks ago but thought better of it and just let the government sort them out, but even they cannot belive what this guy is saying. Plus the poor girl who is handling the complain said Paul typed everything out in capitals, meaing he was shouting at her.

I ask you is this the sound of a professional company. It's my own fault for not sending it to Sony and waiting thee month or so to get it back but honestly people have rights and if this company wants to just treat me like they can bully and steal my property then this is war.

Paul,On the 18th of July 2009 I dropped off my Playstation 3 serial number S014873316I to be repaired. On Sunday the 19th of July 2009 you gave me a bill for the repair of $340 + $12 to cover fees. As laid out below

This was paid immediately via Pay Pal as instructed and confirmation emails sent out (email 002). I went t pick the unit up late on Sunday afternoon as told it would be ready only to be instructed that confirmation of payment had not been made. I had proof of payment with me yet Paul Johnson refused to acknowledge this. Email (email 002) of proof was sent via email to mods@blade.cc on Sunday the 20th of July 2009. When I contacted Paul Johnson the next day I was told he was away till Wednesday. This could have been told to me on Sunday. I then received and email on Monday the 20th of July 2009 to state that the unit had been picked up by courier and it will be delivered to my address (email 003). The PS3 did not return till Wednesday the 22nd of July 2009.
When the PS3 was returned it did not work at all. No Display when plugged in to my TV. This was report via email (email 004) at 4.31PM. A number of emails went back and forth with your response being to check the manual. I responded at 5.20Pm (email 005) stating that I had been through the manual and it did not work.
At 5.54PM I sent you an email (email 006) to state it was definitely not working and I wanted another repair person to speak too.
At 8.14PM on Wednesday the 22nd of July I sent you an email (email 007) stating that I had been able to power the unit up using an LCD computer display and noticed that the system now contained another person private login details. Refer Email. This led me to believe that you had swapped my PS3 for another person’s PS3. The name Lachlan was recorded in the user details where mine should have been, however your email (email 008) at 8.45PM on Wednesday the 22nd of July 2009 stated the following (email 010)

In the warranty report emailed to you the only parts we kept of yours is Power supply and Laser assembly and Eye. As already explained.
Paul has a Standard backup image file extracted from USB drive which isre installed after repair on all PS3 which has HDD data loss -to testsaves and Firmware Flash the PS3 with Tornado 7 Firmware Pack for Full Multi region .
Paul is very happy you finally got it all working - on High resolutionsagain and is grateful to serve your family

At 8.27PM on the same day I sent you an email (email 009) back stating the following;
I appreciate that and sorry to burden you with this and you should explain to Paul how serious this looks. I am a technical person and can see exactly what he has done. He has exchanged my parts for some else’s. That’s pretty clearAfter many more emails with no luck communicating with your company and reaching a resolution I decided to persevere with the PS3 you had returned to me. However of the 2nd of August I loaded a standard DVD movie in to the Play Station 3 and found it would not play it due to the region code being incorrect proving this was not an Australian Standard PS3.I then sent the following email to you (email 011);
Hello again, I decided to persevere with the play station repair you carried out but as of today I can't any longer.
I have just loaded a DVD in to watch a movie and the play station that you repaired will not play it as it is now the wrong region.Add to the frustration of the X & O buttons being reversed I am not very happy.
I am willing to return the unit but I want the device repaired properly with the correct X & O buttons in the correct configuration.I want the Play station to play Australian Region DVD's.
If you cannot provide this service and restore the unit to how it should be I would like a refund of my money so that I can get it repaired by a professional business.
Please be very clear IT MUST BE RESTORED TO HOW IT WAS AND IF YOU CANNOT DO THIS YOU MUST REFUND MY MONEY. YOU MAY TAKE BACK THE PARTS YOU HAVE INSTALLED.

Hello Alister- plse return for a refund to Paul- we need your NTSC Main Board for an Important Client from Japan Sir.
Paul will get you old main board ready to give back to you asap and cash back.

Email 0012 refers to you having to keep this unit to retrieve the main board but there was obviously no repair carried out on my original PS3 as it was swapped for this unit you returned to me so I do not feel it has to be left with you and only needs to be exchanged.
When I went to drop it off no one answered the door and I returned home and sent you the following email (email 013)
Thanks for your prompt answer to this problem.I just went to drop the unit off and Paul was not there.
I have just had my serial number check out and it appears that this PS3 is definitely not mine.
My serial number is S014873316I and the unit he returned to me is cecha12.The unit is clearly labelled NTSC underneath as well when my unit was a PAL model.
This explains the different user details on the hard drive when I got my unit back which means someone else may have my unit with my user name and credit card details in it.
I will hand over this unit for my unit. I can prove that the serial number I supplied is my PS3 and it is that one that I must have back. Not this one.At no pint was there a discussion of an exchange or refurbished unit being supplied to me and this would be considered against the law here in Australia.There should be no need for me to wait around, Paul should have my PS3 at his house and be able to swap it. As this unit he supplied is working somewhat all we Need to do is exchange PS3's.
So can you please organise an exchange of units with Paul. I am not angry and appreciate he tried to help me out but swapping the unit without my consent and not allowing me to erase the hard drive of my private information is wrong.
I must have my original PS3 with the matching serial number returned to me and my money refunded. I can then get this to Sony to be repaired.
Please ensure Paul has my original PS3 left with him, get him to text me when it is available. The serial number above will match.
Please understand I mean no disrespect but I do have a right to have my own unit returned to me.

Yes Sir Correct- as you could not wait for Paul to get back on That Tuesday we replaced the console.You insisted on getting a console immediate- we responded.

I went to see Paul Johnson at 6.30 PM on the 3rd of August 2009 at his address of 20 Brighton Ct Albany Creek. He invited me in to his house told me to leave the unit and I had until 3 to get out and he proceeded to count. I felt threatened and in danger and did not leave the exchanged PS3 as it is the only item I have left and you have already proved dishonest. I sent you an email (email 015) to confirm this.I also explained that I was not willing to leave this playstation 3 in his possession until my original PS3 with matching serial numbers was returned to me. (email 016)
It is clear that you have admitted in email #014 that you have exchanged my PS3 for another one. At no point was this agreed between us.All your emails prior to the 3rd of August State that you repaired my PS3 (email 010). This is illegal.
I have demanded the return of my original PS3 that matches my serial number plus a full refund of repair bill of $352 of which you have said you agree to in email #012.
On many occasions I have told you that I do not wish to deal with Paul Johnson due to aggressive nature and at no time have you provided me with an alternative contact or repair point.
At 7.00 PM on the 3rd of August I attended Ferny Grove Police station and made a formal complaint for Constable Ben Mosedale.
On the 5th of August I also lodged a complaint with the ACCC and the office of fair trading and have been advised to send you this official letter of complaint of which a copy will be forwarded to their complaints department and the police.
My demand is that Paul Johnson returns my original PS3 in the same condition it was left with him. I also wish to receive a full refund for the amount for $352. This must occur within 7 days from Monday the 3rd of August 2009. After I have received my original PS3 I will return the Non Australian PS3 you delivered to me.
If in the event that my original PS3 cannot be returned you must compensate me by supplying a PS3 of the exact same model, being 60 GB fully backwards compatible within 7 days as of the 3rd of August 2009.
You must also supply the known where abouts of my original PS3 within 7 days as of the 3rd of August 2009, which contained my personal information that contravenes privacy laws.
If you fail to meet these requirements I will take further action

The reponse to the office of fair trading has been negative, Paul says I can pay $380 to have the image restore meaning all up the repair bill will exceed the cost of a new machine. The girl at the office of fair ttrading couldnt beleive the response from him and has suggested we now use the full force of the law to enforce what is right.

As I said I have been pondering over whether to take this type of action or not but now it is clear that others must be warned about them.
